privacy policy

The privacy policy as below:

  • Unless otherwise agreed between the Parties in writing or if required under law or regulation, the Parties shall, to the extent practicable and possible, procure that their respective representatives shall keep confidential all information.
 
  • The Client shall not, unless required by any law or regulations (either before or after the termination of the Agreement), disclose to any person not authorised by the Huge Mind to receive the same, any information relating to the Huge Mind or to the affairs of the Huge Mind or which the Client disclosing the same shall come to possess during the period of the Agreement and the Client shall use its best endeavours to prevent any such disclosure.
 
  • Except as permitted in writing and signed by the Client, the Parties hereby agree that during the term of the Agreement and thereafter, the Huge Mind may not use for commercialization, disclose to any person the Confidential Information by the Client.
 
  • Huge Mind will not use Client’s name, likeness, logo or any form of identity that may represent the Client without Client’s prior written consent, to include use or reference to Client’s Identity in any way and in conjunction with the customers of the Client, its potential clients, list of clients and customers, the news releases or releases to any professional or trade publications.
 
  • All confidential information shall not be disclosed by the Huge Mind to third parties and shall continue to be in force even at the termination of this Contract.

Terms & conditions

The terms & conditions as below:

  • Unless for the Client’s benefit, the Huge Mind will not use any third party, or any pre-existing intellectual property in connection with this Agreement. Should the Huge Mind use such pre-existing intellectual property, the Huge Mind will be obliged to obtain from the third-party owner the right to use such intellectual property and in no way shall be the Client be burdened of any inconvenience caused by the Huge Mind in the engagement to any Agreement.
 
  • All works and intellectual property as to the product result of the service provided by the Huge Mind to the Client shall be owned by the Client, including 3rd party Pre-Existing Intellectual Property if there is any, as it being incorporated to the deliverability by the Huge Mind to the Client, with the license including the right to sell, use, reproduce, modify, adapt, display, distribute, disclose, and to sublicense, among others. 
 
  • Huge Mind may not have any right or interest in any of Client’s Intellectual property, except for the limited use which is for the benefit of the Client.

cancellation

The cancellation terms as below:

  • Any Agreement shall become effective and binding on the Parties and shall continue in full force and effect unless and until the Agreement is terminated by Client without liability at any time, upon prior written notice to Huge Mind.
 
  • Upon termination, Huge Mind will provide Client a report of the status of any project, in progress or completed, by the Huge Mind. Client shall not withhold any payment to Huge Mind the equitable amount for the partially completed work in progress and the agreed to price for the completed Services and/or Deliverables provided and accepted before the end of the Agreement. Huge Mind shall return all Confidential Information, including all notes, records or any file to the Client which in any way may incorporate Confidential Information provided by Client to Huge Mind.

Payment & refund policy

The payment & refund policy as below:

  • The Huge Mind will charge the Client based on the project rate.
 
  • The Client needs to make a deposit payment of 10% based on project value before the project can be carried out for any of project value that exceed RM1,000. The Client needs to make the settlement amount after the project is fully handed over to the Client.
 
  • For the project value less than RM1,000, Client needs to make the full payment after the project is fully handed over to the Client.
 
  • Payment of the settlement amount must be made within 30 days after the project is fully handed over to the Client. Otherwise, a late penalty of 10% of the full amount will be imposed.
 
  • Payment can be made by credit card, direct debit, online banking and cheque to the Huge Mind’s bank account.
